Then involvement is essential. You cannot stand aside as a member of a community. The real involvement presupposes first a connection at the level of understanding the phenomenon, an empathic relationship with the studied phenomena and processes, relationship that generate intuitions, leaps in understanding and knowledge, discoveries, revelations. We integrate information from distinct domains, especially in metaphor. What sort of cognitive architecture underlies this kind of integration? Fodor (1983) argued that it involves nonmodular mechanisms. He also contended that the nonmodular mechanisms evolved from modular ones through a process of demodularization, a position elaborated by Mithen (1996). In this article, I defend Fodor and Mithen from criticisms offered by Sperber (1994). Sperber suggested that nonmodular mechanisms are unlikely to have evolved because an increasingly large database would incapacitate the (...) cognitive system due to combinatorial explosion and the frame problem. Moreover, he argued that nonmodular mechanisms are not required to explain our ability to integrate information. I argue that proponents of demodularization can respond to Sperber's criticisms by assuming that either an expanding database co-evolved with increasingly sophisticated search mechanisms or the cognitive system evolved along connectionist lines. Moreover, I argue that Sperber's modular account of conceptual integration fails to satisfy the criteria for modularity-namely, information encapsulation. (shrink)

Managing ethical behavior is a one of the most pervasive and complex problems facing business organizations today. Employees' decisions to behave ethically or unethically are influenced by a myriad of individual and situational factors. Background, personality, decision history, managerial philosophy, and reinforcement are but a few of the factors which have been identified by researchers as determinants of employees' behavior when faced with ethical dilemmas. The literature related to ethical behavior is reviewed in this article, and a model for understanding (...) ethical behavior in business organizations is proposed. It is concluded that managing ethics in business organizations requires that managers engage in a concentrated effort which involves espousing ethics, behaving ethically, developing screening mechanisms, providing ethical training, creating ethics units and reinforcing ethical behavior. According to Goodman (1972), two things are similar only if they possess relevant common properties. The relevance of properties, however, can vary with the context and with the goals of the person making the comparison. As a result, similarity is a highly unstable relation, and therefore difficult to use as a base from which to explain other processes, such as analogy, induction, categorization, and metaphor. A recent attempt by Gentner and her colleagues to explain the operations of the comparison process (...) in analogy may run across some of these difficulties. In particular, her structure-mapping theory (Gentner, 1983, 1989; Gentner & Markman, 1997) does not explain how the relevant features are accessed during the early stages of the comparison process. Moreover, progress on this problem will not be made until we have a solution to a more general problem--the problem of explaining how people manage to bring relevant information to bear in the processing of new information. The theories of information ethics articulated by Luciano Floridi and his collaborators have clear implications for law. Information law, including the law of privacy and of intellectual property, is especially likely to benefit from a coherent and comprehensive theory of information ethics. This article illustrates how information ethics might apply to legal doctrine, by examining legal questions related to the ownership and control of the personal data representations, including photographs, game avatars, and consumer profiles, that have become ubiquitous with the (...) proliferation of information and communication technologies. Recent controversy over the control of player performance statistics in “fantasy” sports leagues provides a limiting case for the analysis. Such data representations will in many instances constitute the kind of personal data that information ethics asserts constitutes an information entity. Legal doctrine in some instances proves sympathetic to such an assertion, but remains largely inchoate as to which data might constitute a given information entity in a given instance. Neither is information ethics, in its current state of development, entirely helpful in answering this critical question. While information ethics holds some promise to bring coherence to this area of the law, further work articulating a richer theory of information ethics will be necessary before it can do so. At common law, contributory infringement for copyright infringement requires "knowledge" of the infringing activity by a direct infringer before secondary liability can attach. In the USA, the "safe harbor" provisions of the Digital Millennium Copyright Act, that shield Internet Service Providers from secondary copyright liability, are concomitantly available only to ISPs that lack the common law knowledge prerequisites for such liability. But this leads to the question of when a juridical corporate entity can be said to have "knowledge" under the (...) statute. Legal institutions have well-established processes for inferring the knowledge state of natural persons, but corporations are complex sociotechnical networks of human and non-human elements whose information state does not map well onto such inferential methods. This question is of course not unique to copyright liability; corporate entities may be responsible for "knowing" actions under a variety of applicable legal provisions, and the question of corporate knowledge is generally under theorized. But consideration of ISP "knowledge" in this context points the way to consideration of corporate epistemology that must be foundational to determining corporate responsibility in copyright protection. © The Author 2011. Extending the work of Davidson and Worrell, we further investigate the stock market''s reaction to announced corporate illegalities. We examine a sample of 535 announcements of corporate crime and obtain an overall insignificant stock market reaction. However, when the sample is divided by type of crime, we find that the stock market reacts significantly to announcements of bribery, tax evasion, and violations of government contracts. We also find a significantly negative reaction to announcements of corporate crime when the company had (...) been previously accused of other illegal activity. For companies accused of crime in the 1970s, 51% of them were accused again in the 1980s. (shrink)

In this article, we hypothesize that the level of environmentally oriented noncompliance regulatory fines and penalties levied on companies and on their industry counterparts will be associated with the development of an environmental infrastructure and practices within these companies. We find that the presence of these regulatory actions is associated with the likelihood of companies reporting environmental policies and activities and with the presence of a separate board of directors’ committee that monitors company environmental concerns. Our findings suggest that environmental (...) regulatory pressure may serve as a driver of environmental action but is not its only determinant. (shrink)

In this research, the authors present a model that demonstrates that motivating managers to change unpopular or irresponsible corporate behavior may be required when the stakeholders desire such a change. Using agency theory, they then test part of the model and demonstrate why it may be necessary for an organized protest to impact on share prices before managers choose to change the behavior. Investors' reactions to announcements of product boycotts and stock divestitures made over the 23-year period 1969-1991 were examined. (...) Announcements about boycotts were associated with significant negative market reactions, whereas divestiture announcements resulted in no significant market responses. From a pure stock market perspective, boycotts appear to be a more effective tool in influencing managers to change a company's behavior. (shrink)

Alice dit : « Pour autant que je sache, l’eau pourrait ne pas être du H2O. » Intuitivement, il semble qu’Alice ait dit quelque chose de vrai. Autrement dit, il semble qu’il soit épistémiquement possible (pour Alice) que l’eau ne soit pas du H2O. Pourtant, les conceptions traditionnelles de la modalité en linguistique et en philosophie du langage prédisent que tout énoncé métaphysiquement (...) impossible est également épistémiquement impossible (pour qui que ce soit). Or, il y a des arguments plausibles, venant de Kripke et d’autres, qui prétendent montrer qu’il est métaphysiquement impossible pour l’eau d’être quoi que ce soit d’autre que du H2O. Selon ces conceptions standards de la modalité, Alice a donc en fait dit quelque chose de faux. Ce résultat est hautement contre-intuitif. Je propose une nouvelle théorie de la modalité qui est capable de représenter ce que j’appelle des IMEPs : des impossibilités métaphysiques épistémiquement possibles. Des phrases comme : « L’eau pourrait ne pas être du H2O» et « Hesperus pourrait ne pas être Phosphorus » sont des exemples d’IMEPs, et d’autres peuvent être facilement trouves (y compris certains qui ne reposent pas sur des considérations kripkéennes touchant a la possibilité métaphysique). Ma théorie explique l’existence d’IMEPs tout en conservant la souplesse et la puissance explicative des conceptions standards. (shrink)

The area of biomedicine is one of the fastest developing areas of science and technology. The perception of its possible and expected positive or negative impacts results in the growing number of bioethical discussions in scientific community, politics and public. Their intensity, focus and used methods differ from country to country. Th e authors of the prologue have tried to map the state of the art and expected development of bioethical discussion in the countries of Middle and Eastern Europe. In (...) the beginning, they addressed the bioethical experts with short questionnaire from 7 “new” European countries and two “old” European countries. In the end, seven experts have responded their questions and expressed their expectations and difficulties of the development of bioethical discussions and institutionalisations in their countries. Over the past 30 years, computer engineering has developed a lot. Currently, computer and software applications have a central role in business, medicine, security, communications, industry, education, and everyday life. Software developers, peoples who manage computer networks, data security analysts can do well, but they also have the potential to cause suffering and harm to the clients or ordinary peoples, willingly or not. For this reason, IT activities must be regulated by specific laws. From the beginning, we argue that the (...) law is not the same thing as ethics, even if both promote the good. Certain ethical principles can be strengthened by law. In the field of computer science and technology, can exists theft, privacy violations, violence and harassment. To combat and punish such actions and behaviors, law is needed. But is software engineering a profession? If so, are there codes of professional ethics whereby specialists in the field can regulate their professional activity, as is the case, for example, in areas such as justice or medicine? In relation with that, Gibbs and Ford have identified 8 components of a professional infrastructure. Some of that is: initial vocational training, professional accreditation, licensing, continuous vocational training, the existence of code of ethics.. With the fact that software engineering is a profession, in this article we present the main principles of behavior. The principles are not legally binding. This are grouped by interest categories depending on who or what is involved in the interaction with software engineering. (shrink)

Rejouant ainsi un cliché de la littérature médiévale — la dichotomie entre le liber scripturae et le liber naturae, monde du livre et livre du monde —, Montaigne se trouve dépassé (...) par Descartes, pour qui la quête de la vérité ne peut finalement se passer de l'étude en soi-même. L'excès cartésien, qui consiste à récuser le liber naturae autant que le liber scripturae, non sans les avoir préalablement pratiqués, va alors de pair avec la promotion d'une subjectivité de type transcendantal opposée à la subjectivité montanienne. Our article attemps to show the First Part of the Discours on Method is the place of Montanian experiences ordered under two types of practice: practice of books on one hand, practice of travels on the other hand, in other words in reading of the authors and company of the world. So replaying a cliché of medieval literature — the dichotomy between liber scripturae and liber naturae, world of the book and book of the world —, Montaigne is exceeded by Descartes, for whom the quest of the truth cannot finally do without the study in the self. The Cartesian excess, which consists in rejecting the liber naturae as much as the liber scripturae, not without having practised them beforehand, then keeps pace with the promotion of a transcendental subjectivity opposed to Montanian subjectivity. It is natural to think of legal positivism and jurisprudential naturalism as intellectually allied ideas. Legal positivism is associated with the idea that law is a matter of social fact; naturalism is a philosophical tenet that, among other things suggests the importance of scientific findings and methods to philosophy. At the very least, there seems to be a close family resemblance between the two views. In this essay, I challenge this view from a naturalistic perspective. I show that the best-known (...) proponents of legal positivism in the twentieth century all rejected naturalism. I dedicate most of my discussion to H.L.A. Hart’s version of legal positivism, as it appears superficially friendly to naturalism. I show that throughout his career and in writings on a wide range of topics, Hart consistently argued against the applicability of the methods of science to the explanation of social phenomena. This is not a small matter: I argue that it is this anti-naturalistic stance that contributed to his descriptively faulty account of adjudication. After reviewing more briefly the work of other leading legal positivists, I argue in my conclusion that those seeking to advance a naturalistic approach to law should turn their backs of much of twentieth-century legal positivism, which in various guises has been hostile to naturalism. On the unorthodox ways in which people relate to each other.

Pada 11 Oktober 2012 Gereja Katolik merayakan 50 tahun dibukanya Konsili Vatikan II. Namun demikian, 16 dokumen yang dihasilkan selama Konsili itu berlangsung (11 Oktober 1962-7 Desember 1965) belum dikenal oleh semua umat Katolik. Bahkan ada tidak sedikit umat Katolik yang belum pernah melihat dokumen-dokumen tersebut. Ada pula yang mengatakan bahwa kendati sudah membacanya, namun merasakan sangat sulit untuk memahaminya. Ada pula yang ketika melihat buku tebal yang memuat dokumen-dokumen tersebut langsung merasa terintimidasi dan ketakutan (intimadated), lalu tidak berani membukanya. (...) Sudah ada berbagai macam upaya untuk menyampaikan isi dan semangat dari Konsili Vatikan II kepada seluruh anggota Gereja Katolik. Salah satu cara adalah menerbitkan buku untuk mengulas isi dokumen-dokumen tersebut. Salah satu dari sekian banyak buku yang pantas dibaca adalah karya Maureen Sulivan, seorang assistant professor ilmu Teologi di Saint Anselm College, Manchester, New Hapshire, Amerika Serikat. Buku yang ditulis dalam bentuk tanya jawab ini dibagi menjadi 9 bab. Bab 1 berbicara mengenai “Pengumuman” diadakannya Konsili yang menggemparkan para pemimpin Gereja, khususnya anggota Dewan Kardinal dan Kuria di Vatikan, yang merasa bahwa Konsili tidak diperlukan. Dalam bab ini dibicarakan tentang arti dari Konsili yang disebut sebagai ekumenis dan pastoral, alasan perlu diadakannya Konsili, persiapan yang dibutuhkan, serta tujuan yang ingin dicapai dengan diadakannya Konsili Vatikan II. Secara khusus disebutkan peran almarhum Paus Johanes XXIII, yang ketika mengumumkan untuk mengadakan Konsili, beliau baru tiga bulan diangkat menjadi Paus. Lewat Konsili ini beliau menginginkan agar Gereja mampu menemukan cara agar iman Kristiani dapat disampaikan kepada dunia dan dimengerti oleh dunia. Demi tujuan itu Gereja perlu “membuka jendela” agar “angin segar memasuki dirinya (hlm. 29).” Gereja perlu melakukan aggiornemento, pembaruan diri. Bab 2 mengulas mengenai orang-orang yang berperan dalam KonsiliVatikan II, ketegangan-ketegangan yang muncul antara mereka yang ingin mengadakan pembaruan dengan mereka yang ingin mempertahankan status quo Gereja, serta peran media massa. Selain sekitar 2200 peserta (Kardinal, Uskup, dan Abas), juga terdapat ratusan teolog yang berperan sebagai penasihat bagi para peserta Konsili (periti), antara lain dengan memberikan seminar-seminar mengenai topik-topik teologis kepada para peserta Konsili (hlm. 35-36). Selain itu juga terdapat para pengamat dari Gereja Ortodoks, Gereja-gereja Protestan main streams (Lutheran, Episkopalian, Anglikan, Metodis, Presbyteran, dan Quakers), dan Yudaisme. Hadirnya para pengamat dari kalangan khusus ini merupakan sesuatu yang baru dan revolusioner dalam Konsili. Secara khusus ditampilkan seorang tokoh pembaru: Kardinal Bea, ketua Sekretariat untuk Kesatuan Umat Kristiani. Ia begitu dikenal dengan ucapannya yang sangat menggemparkan di depan para wartawan: “Members of the other Christian Churches who are living today never ’left’ the Church. So they cannot ‘return,’ can they? We are talking about going together, hand in hand, toward a new future” (hlm. 33). Tokoh pembaru lain adalah Kardinal Achile Liénart, seorang Kardinal senior dari Prancis, yang pada hari ketiga Konsili menolak untuk memilih dari daftar nama yang sudah disiapkan (kebanyakan adalah anggota Kuria) untuk menjadi ketua dari 10 komisi yang akan mengendalikan agenda Konsili. Ia mengusulkan supaya para peserta Konsili memilih orang-orangnya sendiri. Usulan ini didukung oleh Kardinal Josef Fring dari Jerman, dan kemudian diterima oleh semua perserta Konsili. Tokoh pembaru lain adalah Kardinal Jan Alfrink dari Belanda, dan Kardinal Leo Josef Suenens dari Belgia (hlm. 38-38). Di pihak lain, ada tokoh sangat konservatif yang mencoba menghambat jalannya Konsili: Kardinal Alfredo Ottaviani, seorang anggota Kuria dan ketua The Holy Office (sekarang dikenal sebagi Kogregasi untuk Ajaran Iman), yang terkenal dengan ucapannya “Semper idem” (Selalu sama). Ia antara lain melawan hadirnya para pengamat dalam Konsili (hlm. 33), mencoba melarang kuliah-kuliah yang diberikan kepada para peserta Konsili oleh para Yesuit dari Institut Biblis di Roma, bahkan meminta Paus Yohanes XXIII untuk mengusir teolog Yesuit, Karl Rahner dari Roma, yang tentu saja ditolak oleh Paus (hlm. 35). Ia menolak penggunaan bahasa-bahasa lokal untuk Misa, yang intinya adalah pemindahan kekuasaan dari hierarki kepada Umat (hlm. 43), menghambat disahkannya kolegialitas para Uskup dan menandaskan bahwa Komisi Teologi yang ia pimpin memiliki otoritas di atas Konsili (hlm. 55). Dalam bab ini juga disebutkan hal yang baru dalam Konsili ini adalah hadirnya para wartawan dari pelbagai media massa dari seluruh dunia........................................... Sebagai penutup, dalam bab 9, Sullivan menegaskan bahwa ada dua hal yang benar-benar perlu diperhatikan untuk zaman ini sebagai agenda yang belum selesai dari Konsili Vatikan II: kolegialitas (relasi atara Paus dan Uskup) dan peran kaum perempuan dalam Gereja. Akhirnya, pada awal abad ke-21 ini Sullivan mengajak kita semua untuk bertanya: Apakah Gereja kita sungguh-sungguh dapat menjawab tantangan-tantangan pada zaman ini?; Apakah Gereja kita dapat membuat pesan Injil relevan untuk zaman ini?; Apakah Gereja kita dapat membangkitkan entusisme baru yang dapat membangun sebuah generasi baru?; Apakah Gereja dapat meredakan berbagai macam ketegangan yang akhir-akhir ini menggoncang “bahtera Petrus?” Dengan bijak Sullivan mengatakan bahwa kita perlu terus berharap, dan harapan itu akan menjadi semakin produktif kalau kita selalu berpegang pada nasihat almarhum Yohanes XXIII: “Untuk hal-hal yang mendasar, kesatuan; untuk hal-hal yang meragukan, kebebasan; dan untuk segala sesuatu, cinta kasih” (hlm. 124). Buku ini sangat komprehensif mengulas Konsili Vatikan II dan disampaikan dengan bahasa yang sederhana. Buku ini sangat membantu para pembaca karena dilengkapi dengan daftar isi yang mendetil, daftar semua dokumen yang dihasilkan oleh Konsili Vatikan II beserta dengan waktu promulgasinya, daftar istilah-istilah yang penting berkaitan dengan Konsili Vatikan II, serta indeks subjek. Semoga dengan membaca buku ini para pembaca terdorong untuk membuka dan menemukan pesan-pesan penting dari dokumen-dokumen Konsili Vatikan II. Kur’an’ın anlamını doğru tespit ve te’vil etmek çabasında kullanılacak araçlardan biri de nüzûl vasatı ile esbâb-ı nüzûl rivayetlerine vukûfiyet ve bunları doğru tahlil etmek için isabetli bir yaklaşımı benimsemektir. Âyetlerin tefsirinde sahip olduğumuz kanaatlerin ve açıklamaların birçoğu esbâb-ı nüzûl rivayetlerine dayanmaktadır. Bu rivayetlerin Kur’an’ın muhtevasına, hadis usulüne, rivayet kalıplarına, siyerle uyumuna göre değerlendirilmesi gerektiği şeklinde görüşler serdedilmiştir. Mesela Medineli Yahudilerden Ka’b b. Eşref’in Bedir sonrasında öldürüldüğü kabul edilmekle birlikte ismi bu tarihten çok sonra nazil olan ayetlerin te’vilinde konuyla ilgili rivayetler (...) nakledilmektedir. Tarihsel açıdan bu çelişkili durum esbâb-ı nuzûl rivayetlerinin tarihî vakıa ile uyumunu araştırmanın önemini göstermektedir. Bu makalede yukarıda zikrettiğimiz hususları Ka’b b. Eşref örneği üzerinden ele alarak, kaynaklardaki bilgileri analitik olarak değerlendirmeye çalıştık. Sonuç olarak konuyla ilgili diğer tartışmalara girmeden tarihî bakış açısıyla rivayetleri tarihe ve zamana uyum açısından değerlendirerek, selefin kastı doğru anlaşılmadığı ve tarihi tutarlılığa yeteri kadar dikkat edilmediği için isminin vefatından sonra nazil olan birçok ayetin esbab-ı nüzûlünde zikredildiğini tespit ettik. This study of major corporations (n=481) provides an empirical assessment of the effects of several corporate governance variables (CEO duality, boards of director composition, officers and directors common stock holdings, institutional common stock holdings, number of majority owners) on the adoption of so-called severance agreements. A discriminant analysis indicates a significant multivariate function. Wilks lambda univariate analyses suggest that the percentage of common stock held by owners and directors and number of majority stock holders are the more robust discriminators.

The negative effects of the techno-economicus paradigm engender the reemergence of homo ecologicus, which offers wisdom of life. Homo ecologicus has also been quite marginalized from the life of humanity. The reemergence of homo ecologicus, in turn, would give a new hope for the reemergence of the face of the homo religiosus, because of its (...) interrelated characteristics with the homo ecologicus. In fact, humans can be called homo eco-religiosus. The close tie between the two needs to be investigated more deeply with the help of philosophy. But, the philosophy we need is not just a Cartesian analytical philosophy, which means a merely intellectual exercise in the public domain. What we need is a philosophy as a philo sophia, love for wisdom, which will lead to an exercise of both feelings and soul in the private domain.
